Supreme Court Narrows Scope Of Previous Immigration Ruling

WASHINGTON -- The Supreme Court says there can be no retroactive application of its ruling that lawyers have to tell their clients if pleading guilty to a crime could cause their deportation.

The high court's 7-2 ruling came Wednesday in the case of Roselva Chaidez.

The Supreme Court ruled in 2010 that immigrants have a constitutional right to be told by their lawyers whether pleading guilty to a crime could lead to their deportation. Chaidez had already been convicted for mail fraud and was in a deportation proceeding. She then asked the courts to allow her to take advantage of the new ruling.

Justice Elena Kagan wrote that the 2010 ruling was a new rule, so it doesn't apply to convictions that came before. Justices Sonia Sotomayor and Ruth Bader Ginsburg dissented.

10 South African Stocks Poised to Beat the ... - Investing In Africa

It?s time to stick my neck out.

I?ve talked a lot about the past performance of various African stocks, and I?ve asked a number of local experts for their favorite listings. But I haven?t often gone out on a limb and made picks of my own, and many of you have noticed.

So, it?s only fair that I go on record with my best bets.

Here are my top South African stock picks. I expect that, on average, they will outperform the Johannesburg Stock Exchange All Share Index over the next 12 months.

ARB Holdings (ARH: SJ) ? Price: R4.80,?P/E Ratio: 13.0, DivYield: 2.9%

ARB wholesales electrical products ranging from overhead cable to light fixtures. It?s not a market devoid of competition, and ARB has the narrowing margins to prove it. But consider this. The South African government has committed to spending R210 billion over the next 10 years to improve the nation?s transmission grid. What?s more? ARB is the largest independent wholesaler in the industry, so it is perfectly placed compete for much of that spend. Factor in an experienced, heavily invested management team and a balance sheet free of long-term debt, and I conclude that this one is a winner.

Bowler Metcalf (BCF:SJ) ? Price: R7.86, P/E Ratio: 10.9, DivYield: 4.6%

This 40-year-old family-run plastics and soft drink business reported a drop in earnings during its 2012 fiscal year due to a two-month labor strike and a shortage of CO2. The market didn?t much like this, so the company?s share price has dropped nearly 9% over the past year. But management doesn?t seem too worried, boosting the dividend in spite of the fall in earnings. The reason behind their confidence may stem from a new high-speed bottling plant and expansion into the Johannesburg market. The impact of both these moves is yet to trickle down to the bottom line. But I expect that we will see earnings rebound nicely in 2013.

Calgro M3 (CGR:SJ) ? Price: R5.20, P/E Ratio: 7.9 DivYield: N/A

Calgro M3 develops and builds low-income housing in a country with an enormous need for it. Moreover, with low interest rates prevailing, this sector of the population is increasingly able to afford homeownership. Management appears to be capitalizing on the opportunity. Operating profit more than doubled during the first half of its 2013 fiscal year, up 147%. Yet the company trades at less than eight times its trailing earnings. That?s an earnings yield of nearly 13%. And the future looks bright. The company has built an order book nearly twice as large as its total 2012 sales.

Cashbuild (CSB:SJ) ? Price: R135.00, P/E Ratio: 10.7, DivYield: 4.2%

Much as its name implies, Cashbuild is a retailer of basic building supplies to low-income, but primarily cash-paying customers. It operates nearly 200 stores throughout Southern Africa. Cashbuild?s share price got hammered last month when it reported slowing same store sales growth, dropping 7.9% in a single day. In my view, this presents a nice buying opportunity at a trailing earnings multiple of less than 10. If the company continues its northward push into the continent and scales up its credit sales, we could see some towering results out of this stock.

Ellies (ELI:SJ) ? Price: R8.70, P/E Ratio: 11.5, DivYield: 1.2%

Ellies sells television reception equipment and electricity generators, both hot items in a nation with a constrained power supply and virtually non-existent cable television network. It stands to benefit immensely when South African television converts from an analog to a digital signal because thousands of households will need to purchase a set-top converter box to watch their favorite programs. The company is also blessed with a solid management team that has kept the balance sheet essentially free of debt. With earnings growing 102% over the past twelve months and bright prospects, this stock is bargain-priced.

Holdsport (HSP:SJ) ? Price: R44.49, P/E Ratio: 12.5, DivYield: 3.2%

Holdsport runs two chains of sporting goods stores. One focuses on athletic equipment and clothing, and the other sells hiking and camping gear. When I first looked at this company last year, I had questions about its long-term prospects given its failure to establish much of a presence beyond South Africa?s borders. But the company is still small with less than 60 outlets currently in operation. This fact combined with strong sales growth and a significantly less demanding valuation than other South African retailers prompted me to reconsider my position.

Howden Africa (HWN:SJ) ? Price: R27.00, P/E Ratio: 10.4, DivYield: 2.0%

An affiliate of the global industrial group, Colfax (CFX:US), Howden Africa manufactures fans, pumps, and air cleaning equipment for a wide range of industries. This focus has paid substantial dividends over the past few years, as Southern Africa invests increasing amounts of resources into power production, construction, and manufacturing. Earnings nearly doubled during the first half of 2012 and the business continued to spin off gobs of cash. Couple this with annualized sales growth of 14.1% over the past five years and a pristine balance sheet, and I think we?re looking at a winner.

Hudaco Industries (HDC:SJ) ? Price: R95.00, P/E Ratio: 8.9, DivYield: 4.9%

Now marking its 75th year as a listed company on the Johannesburg Stock Exchange, Hudaco imports and distributes car parts and power tools. Selling things like belts and ball bearings certainly isn?t the sexiest of businesses, but it?s hard to complain about a business that has grown earnings at a 12.5% clip since 2008. Because their product line, in large part, keeps vehicles on the road, Hudaco is shielded from economic dips more than an auto maker would be. Management is also making a push north into other African countries. Export earnings have risen 85% over the past two years.

Trustco (TTO:SJ) ? Price: R1.10, P/E Ratio: 3.1, DivYield: 1.8%

This Namibian group is one of the strangest companies I?ve come across in Africa, but strange in a good way. It operates in the education, micro-insurance, and micro-finance sectors. The company sells life insurance to low income communities; often by packaging it with mobile phone airtime or as a perk awarded to frequent shoppers at stores like Shoprite. It also provides financing for distance education courses through its own educational institution. Finally, it owns high value real estate in and around the Namibian capital, Windhoek. And did I mention the IFC wants to buy a chunk of shares? This one looks very cheap.

Value Group (VLE:SJ) ? Price: R5.68, P/E Ratio: 8.6, DivYield: 3.9%

How could an investor not like a stock with a name like ?Value Group?? This logistics company runs warehouses, rents out trucks, and repairs forklifts, and its spent a lot of money over the past few years to upgrade its fleet and infrastructure. Now that this capital spend is complete, management plans to pay down debt and explore opportunities in the rest of the Sub-Sahara. Given the tough business environment in South Africa, I don?t anticipate significant earnings growth over the near term, but at this valuation and yield, I can afford to be patient.

Programs closing the talent gap

Why TCU, Ole Miss and Utah could be on verge of breakthrough seasons

Generally speaking, recruiting success goes hand in hand with on-the-field success. The Alabama Crimson Tide sit atop the college football world and pull in top-flight recruiting classes year after year. The top four teams in ESPN's 2013 RecruitingNation class rankings combined to win 48 games last season. Seventeen of the top 25 teams ranked according to our five-year drive efficiency ratings are also ranked among the top 25 in our five-year recruiting metric.

Some programs are simply looking to take the next step forward. Three of the five teams we identified this time last year as "closing the talent gap" -- Stanford, Texas A&M and UCLA -- went on to have strong 2012 seasons.

Looking ahead to 2013, the following three teams may not have assembled class after class of elite talent, but each has a recruiting profile that is on the rise. And each is expected to take a step forward on the field this season.

TCU Horned Frogs

Program FEI rating: No. 16
Five-year weighted recruiting rank: No. 39
2013 ESPN recruiting class rank: 49

As many expected, TCU's first season as a member of the Big 12 was much more of a struggle compared with its dominating run in the Mountain West over the previous three seasons. From 2009 to 2011, the Horned Frogs won three conference titles, posted a record of 36-3, and played in two BCS bowl games, winning the 2011 Rose Bowl over Wisconsin. TCU had an average schedule strength ranked 83rd over those three seasons, but the Big 12 presented a much more difficult challenge in 2012. The Horned Frogs' 4-5 conference record tied for fifth in league play last year, and the Big 12 schedule will be a tough gantlet again this fall.

TCU's recruiting profile isn't on the same plane as conference big shots Texas and Oklahoma, but the Horned Frogs are on the rise. Comparing our five-year program recruiting metric this year against team profiles from three years ago, TCU ranks second only to Stanford in its talent boost in that span. And the returning starters, especially on defense, should be able to lead the way to a few more conference victories in 2013.

Gary Patterson's defense didn't perform at an all-time high last year, but they held their own against some of the most explosive offenses in the nation. TCU ranked 15th nationally in forcing three-and-outs (40.9 percent of opponent drives) and did so against the eighth-toughest set of opponent offenses according to our data.

The Horned Frogs offense is where the most progress needs to be made this fall. TCU couldn't consistently convert scoring opportunities into points, ranking 122nd nationally in points per value drive. TCU was only 1-for-3 on red zone trips in a seven-point loss to Oklahoma last season. A modest improvement in finishing drives this fall could push TCU to an extra conference victory or two.

Ole Miss Rebels

Program FEI rating: No. 51
Weighted recruiting rank: No. 17
2013 ESPN recruiting class rank: 5
The Rebels just signed one of the best recruiting classes in the nation, a statement from head coach Hugh Freeze that Ole Miss is stepping up to contend with the best programs in the SEC. Ole Miss does boast top-20 talent according to our program recruiting measure, but the league as a whole dominates the recruiting rankings year in and year out, so Ole Miss is still behind half the league in terms of talent accumulated.

The good news for the Rebels is that they won't face most of those teams this fall. Of the seven SEC teams ranked ahead of Ole Miss according to our program recruiting measure, only Alabama, LSU and Auburn are on the Rebels' 2013 conference schedule.

Ole Miss lost three games by a touchdown or less last season, and the key to getting the conference record above .500 this fall is all about field position. The Rebels ranked 108th in field-position advantage last year, losing the field-position battle nine times overall. In November losses to Vanderbilt and LSU, the value lost on field position exceeded the scoring margin of the game. In other words, Ole Miss outplayed the Tigers and Commodores if field position had been neutralized.

Improved special-teams play would do wonders, as Ole Miss ranked 96th or worse in punting, kickoff coverage, punt returns and kickoff returns last year. Average ranks in those categories could improve Mississippi's season-long scoring margin by as many as 50 points. That kind of improvement won't be enough to take down the giants in the SEC, but it would be enough to claim a spot at the top of the conference's second tier.

Utah Utes

Program FEI rating: No. 46
Weighted recruiting rank: No. 35
2013 ESPN recruiting class rank: 48
Like TCU, Utah has found a bit more difficulty with the weekly competition of its new conference than it had in the Mountain West. But also like TCU, Utah's recruiting profile is trending upward, boosted in part by its move to the Pac-12 two years ago. Over the last two seasons in the Pac-12 South Division, the Utes have won only seven of 18 league games. But USC and UCLA are the only other teams in its division that rank higher in terms of total program recruiting over the last five seasons, so the talent is in place to take a step forward this year.

The Utah defense was effective last year, but has room to improve with seven returning starters. Utah allowed only 8 percent of opponent drives to average 10 yards per play or more, 18th-best nationally. It's the offense that needs to step up its game in a big way this year.

Freshman quarterback Travis Wilson was efficient in spots last year, but he'll need to improve consistency after another year of experience. The Utes ranked 100th or worse nationally in most of our offensive drive efficiency measures (three-and-outs, available yards, explosive and methodical drives). Special teams keyed by one of the country's best kickoff-return teams helped keep Utah ahead of most opponents in terms of field position. If Wilson and the rest of the offense can improve by a mere 0.5 points per drive, they'll find themselves in the thick of the Pac-12 South race in 2013.

(AP) ? Survivors of a 2003 nightclub fire that killed 100 people and relatives of those killed huddled together in bitter cold Sunday at the site of the fire to mark the 10th anniversary of the fire.

Some brought flowers and paid their respects at the handmade crosses that dot the site for each person who died. Others cried and spoke of missing their loved ones and the difficulty of moving past such trauma.

"People that weren't here really don't understand why we can't let this stuff go. I was 30 seconds away from dying," said Walter Castle Jr., 39, a survivor who suffered third-degree burns in his lungs, throat and bronchial tubes. He said he lost many friends and was in counseling until 2009. Recently, as the 10th anniversary approached, he began having terrible nightmares and had to go back into counseling.

"It's just very tough," he said.

The anniversary of the blaze is Wednesday. The fire broke out when pyrotechnics for the rock band Great White ignited flammable packing foam that had been installed in the club as soundproofing. Last month, a fire at a nightclub in Brazil killed more than 230 people under circumstances that were eerily similar: A band's pyrotechnic display set fire to soundproofing foam.

Among those who spoke Sunday was former Gov. Don Carcieri, who took office the month before the fire and still gets choked up when speaking about it. He remembered the days families waited at a hotel for word that their loved ones' remains had been identified, and the anger everyone felt, asking how the tragedy could have happened. But he also remembered how people in Rhode Island, a state with a population of just 1 million, pulled together to help each other.

"At a time of our state's worst tragedy, in some sense, it was our people's finest hour," he said.

Angela Bogart, who was 19 when her mother, Jude Henault, was killed in the fire, said she has come to know and understand her mother more in the 10 years since she died, especially since she has become a mother herself.

"My mom lives in me in everything I do. I hear her voice wherever I go," she said. "When I walk hand-in-hand with my little girl, my mother is holding her other hand."

The ceremony also featured musical performances, a reading of the names of the people who died and 100 seconds of silence.

While somber, the annual gathering at the fire site took on a more hopeful tone this year than in years past because a foundation set up to build a permanent memorial secured ownership of the site in September after years of trying. On Sunday, the Station Fire Memorial Foundation released final plans for the memorial.

They call for a 30-foot-high entrance gate topped by an Aeolian harp. Wind passing through the harp will create music, a reminder that it was music that brought people together that night.

The permanent memorial will include an individual memorial for each person who died and commemorate the survivors, first responders and those who helped care for families of the dead and survivors in the weeks and months after the fire. It will also include a pavilion as a gathering place.

Families are being asked to remove the crosses and other personal mementos that have been left at the site at the makeshift memorial that has developed over the years. The items left behind will be buried in a capsule under an area that is now the parking lot. There will be no digging on the land under where the club once stood because of the fear of disturbing human remains.

While many of the materials and labor to build the memorial will be donated, foundation officials say they need to raise $1 million to $2 million to build and maintain it.

The foundation hopes to break ground in the spring. Construction of the memorial could take one to two years.

Gina Russo, who was badly burned in the fire and whose fianc? was killed, is president of the foundation and said the memorial would turn the site into something beautiful.

"It's a happy moment going forward," she said.

When to use military force

Re ?When do we fight? (H. Brandt Ayers column, Feb. 10):

I just read Star Publisher H. Brandt Ayers? latest column about when to fight. After reading The Star over the years, I can?t find any time Ayers backed use of military force.

He cloaks himself in the idea that he backs civil rights, yet in his editorials I see no talk about the illegal use of drones to kill U.S. citizens without any proof of terrorist activity. By the memo released recently, the government can decide you?re a threat and without probable cause it can kill you by a mere declaration that you?re an ?enemy of the state.?

What about it Ayers? You say?
