Microsoft makes Windows Phone commercial, sells iPhone instead

Microsoft has released a new commercial for the Windows Phone Nokia Lumia 920, and in it they show off both Apple's iPhone 5 and Samsung's Galaxy S. A lot. So much, in fact, it's hard to know what the commercial is about until the very end, when the Lumia 920 finally makes an appearance. Anyone outside Microsoft see the problem there?

The theme is: Don't fight. Switch. The setting is a wedding where the groom and the bride's side both use different phone platforms, and quickly get into a heated, and pretty funny war of insults that escalates into full-blown Mobile Kombat. When nothing but dust and decimation remains, the waiters wonder if Lumia couldn't just help them all get along.

Here's what Microsoft's Michael Stroh had to say on the Windows Blog:

I chuckled when I first saw the spot. As you?ll see, it plays off the strong?even irrationally strong?feelings some of us harbor about the technology in our purses and pockets. You might recognize someone you?ve met among the wedding guests. You might see shades of yourself. I sure did?and smiled.

I did as well. And it wouldn't be out of place on a late night comedy show. Actually, it would kill as comedy. But this isn't comedy, it's the real, brutal, smartphone market, and here is that Microsoft is promoting Apple and Samsung over their own brands, and that's exactly what happens to them in the market already. Apple had a "switcher" campaign for the Mac many years ago, and while they had a generic "PC" character, he was seldom if ever branded, and there certainly wasn't ever any recognizable, competing hardware in the frame.

Ultimately, however, I didn't really end up caring any more about Windows Phone than I did at the beginning, and that makes it a pretty ineffective commercial. Give it a watch and tell me what you think. Anything there that's better than, I don't know, say Microsoft actually releasing an XPhone Halo edition?

Bangladesh owner is at nexus of politics, business

SAVAR, Bangladesh (AP) ? When the cracks in the building appeared early Tuesday afternoon, a stocky man in his early 30s, a feared political operative who a neighbor says dropped out of school in seventh grade, quickly arrived at the scene in this crowded industrial suburb of the capital.

By then, fear had spread through the 3,200 people who worked in the five clothing factories that jammed the upper floors of Rana Plaza, and the handful of shops on the lower ones. Most of the workers had gathered in the street out front. Few wanted to go back in. Inspectors said the eight-story building should be closed until it could be inspected.

But Mohammed Sohel Rana scoffed.

"The building has minor damages," Rana, the building's owner, told gathering reporters. "There is nothing serious."

The next morning, many of the building's shops and a first-floor bank remained closed. But the factories' 8 a.m. shift began as usual. About 45 minutes into the shift, the building suddenly collapsed, killing at least 350 people in a fury of falling concrete. It was the worst industrial accident in the history of Bangladesh. More than three days later, rescuers are still crawling through the wreckage, hoping to find anyone who has managed to survive so long. By Saturday, nearly all the people being carried out were dead.

Rana, though, has disappeared. He hasn't been seen, according to local media reports, since he left his basement office in Rana Plaza and drove away, just before the collapse. Today, his political patron has abandoned him and authorities want to arrest him.

Rana sits at the nexus of party politics and the powerful $20 billion garment industry that drives the economy of this deeply impoverished nation. Experts say this intersection of politics and business, combined with a minimum wage of $9.50 a week that has made Bangladesh the go-to nation for many of the world's largest clothing brands, has created a predictable danger for factory workers.

Government officials, labor activists, manufacturers and retailers all called for improved safety standards after a November fire in the same suburb, when locked emergency exits trapped hundreds of garment workers inside amid spreading flames and 112 people died. But almost nothing has changed.

"Successive Bangladeshi governments have paid lip service to worker safety but in reality it is only the factory owners who have the ear of policymakers," Brad Adams, the Asia director for Human Rights Watch, said in a statement. "How many factory tragedies will it take before the Bangladeshi government ends its cozy relationship with powerful company owners and prioritizes worker safety?"

Before the collapse, Rana was little known outside of the few blocks of his tiny empire, a grid of poorly paved streets in the crowded industrial suburb of Savar, built up over the past decade or so around hundreds of garment factories.

The son of a local businessman with political connections, Rana became a neighborhood force by working as an organizer for the two political parties that have competed for power for decades in Bangladesh, according to local politicians, as well as someone who grew up near Rana and still lives in the area.

While Rana is currently a leader of the youth group of the ruling Awami League, he has also worked for that party's archrival, the Bangladesh National Party.

"He doesn't belong to any particular political party," said Ashrafuddin Khan Imu, an Awami League leader and longtime Rana rival. "Whatever party is in power, he is there."

In essence, these people say, Rana is a neighborhood political enforcer, regularly ordering thousands of people into the streets for rallies. Most recently, Imu said, he has been working for Awami League lawmaker Talukder Touhid Jang Murad. When Murad was asked about Rana after the collapse, Murad denied any connections. The next day, Dhaka newspapers printed photographs of Murad kissing Rana on the forehead after a successful rally earlier this year.

"He used to intimidate people whenever he needed them, like bringing people out for street marches in support of the lawmaker," said the neighbor, who spoke on condition he not be named, fearing Rana's wrath. "Neighbors would avoid him ... No one wanted to upset him."

Money came with his political connections, with wealth built upon a string of government-owned properties he acquired at reduced prices, according to local media reports. He built a small apartment building and a small commercial building, where a Bata shoe store is now on the ground floor. In 2010 he built Rana Plaza on land that had once been a swamp. He had a permit to erect a five-story building, but built three additional stories illegally.

Until Wednesday, he lived just a few blocks from Rana Plaza, in a five-story red-brick building he owns at the end of a narrow alley. The ground floor has a hand-painted medieval scene, with an aristocratic woman, or perhaps a bride, being carried by scowling bearers in a covered palanquin. The neighbor says he is married, and has two children. The buildings indicate he is a man of considerable stature locally, but is almost certainly not a member of the country's tiny elite.

After the cracks appeared in the building, witnesses say Rana quickly went to work. On Wednesday morning, he and a number of factory managers ordered nervous workers into the building shortly before the collapse, according to the neighbor, who was present at the scene, and local press reports.

"I was too afraid to go inside the building. But the factory officials assured us they would also be in the factory, so there should not be any problem," said Kohinoor Begum, a factory worker who survived but whose hands were injured.

By Saturday night, Rana was still nowhere to be found. Authorities say they detained his wife on Friday, apparently as a way to convince him to surrender.

What will happen to him? At first glance, the situation doesn't look good: He's on the run, his political allies have publicly abandoned him, Bangladesh's most powerful garment industry association says he ignored their warnings to shut the building, the prime minister has called for his arrest.

But in the streets of Savar, many people note that while three managers have been arrested in connection with the Tazreen fire, the factory owner remains free.

Paul McCartney and Wings: Hi Hi Hi

This is a good song. No one is saying that you should listen to it while in any type of altered mental state whatsoever. It's just a good song. The Wings recorded it in 1972 and it got pretty popular, though the BBC was turned off by some of its lyrics. Paul apparently had this to say about their concerns:

The BBC got some of the words wrong. But I suppose it is a bit of a dirty song if sex is dirty and naughty. I was in a sensuous mood in Spain when I wrote it.

Okay people, you heard the man, time for a sensuous trip to Spain.

Lonely year for French president at time of crisis

PARIS (AP) ? The sounds of raucous protest echo in the Presidential Palace, unemployment is rising to levels not seen in over a decade, and his country's economy has been called a potential time bomb at the heart of Europe.

Francois Hollande, among the most unpopular French leaders in modern history, remains calm.

Lacking the early-career charisma of President Barack Obama or the hard-nosed reputation of Germany's Angela Merkel, Hollande rose to power in the Socialist Party as a consensus-builder ? someone who went out of his way to avoid confrontation. But the amiability that propelled him to the presidency a year ago is turning against Hollande, as poll after poll finds deep disappointment among many who believe he is incapable of the swift, determined choices needed to yank France out of a malaise he himself says threatens generations to come.

"I remain solid and serene," Holland told a handful of journalists in his office at the Presidential Palace, above the shouts of a crowd demonstrating against his plan to legalize gay marriage. Without camouflaging the difficulties, he admitted it's been a trying year. "I grasp the seriousness ? it's the task of the president to remain steady and to see further than the storms of a moment. It's called perseverance."

Judgment, he said in the interview earlier this month, will come only at the end of his five-year term.

But, seated comfortably in his office armchair, Hollande insisted he was anything but indecisive.

"My will is to pull the country together and restore its confidence. This will take time, but I have no other goal," he said. "You can criticize my decisions, think that I'm on the wrong path, say I'm foundering, but if there's one thing I'm sure of, it's that I've made major choices for France in the past year."

He cited the accord reached in January between unions and business leaders to relax some of France's famously strict labor protections. Hollande had championed the agreement, saying the costs and difficulties of hiring in France were hurting its ability to compete globally. But unemployment has only risen since then, and the brief optimism generated by the agreement ? which is expected to become law by next month ? has since faded. This week, it reached 10.6 percent, the highest level since 1999.

Hollande talks a lot about the French intervention in Mali, by far his most popular act in office. But, despite Hollande's best efforts, France was alone among European countries in sending soldiers, and French forces outnumbered any Africans sent to win Mali back from the militants who threatened to seize the entire country.

"I became president at an exceptional time," said Hollande, who tends to speak deliberately and formally even in relaxed settings. "Exceptional on the economic front: a long crisis, a recession in Europe, unemployment at historic levels. Exceptional because I was forced to engage France in Mali. Exceptional because populism is taking hold, not just in France, but throughout Europe."

Bernard Poignant, a Socialist who is Hollande's friend of 30 years and also one of his advisors, said the president started his term at a hugely difficult moment for his leftist base.

"Traditionally the left, when it comes to power, is generous, redistributive of wealth," he said. "Today, it's the reverse. The right emptied the coffers and now the left must fill them."

Economists say that France's predicament stems neither from the country's right or left, but from generations of benefits that few politicians are willing to take away. Hollande's predecessor, Nicolas Sarkozy, only half-heartedly tried to raise the work week from 35 hours, then pulled back even before strong opposition emerged.

Hollande cautiously broached the idea of pulling back some of the subsidies that now go to all parents of young children, exempting families who earn high incomes. But the 35-hour work week remains in place, as does the retirement age of 62. Health care remains universal and nearly all treatments are reimbursed at least partially. Hollande has said he will not thin the ranks of government employees. France will remain among the countries with the highest percentage of public workers in the world ? about 20 percent of the workforce gets a government paycheck and a government pension.

Hollande was elected as "president normal," an unassuming contrast to Sarkozy's flashy, aggressive style, and his dramatic divorce and marriage to the model and singer Carla Bruni. But a year into his term, his amiability has managed to turn most of the country against him, even within his own camp. Numerous Socialist lawmakers are openly speaking against him, for example, for demanding they publish their assets.

The president appears to relish simple, easy contact with the French. He can spend hours happily shaking hands, telling stories, joking. But those moments are becoming increasingly rare.

"He is consumed by his responsibilities, too consumed, in my opinion," said Poignant. "The political climate is such that the president is becoming the target of protests. We have to protect him for security reasons: It is very difficult for him to be close to the French."

Only about one in four French approve of the job Hollande is doing, lower than either of his conservative predecessors.

He says he is willing to wait for that to change, describing his five-year term in two phases: things will be very difficult in the first phase, then a return to growth and the Socialist preference toward more government spending. His advisors ? and most economists ? say privately they don't expect much good news for France before 2015.

"The French have always turned to the president. He is accountable to them, and that's as it should be. My actions are measured at this particular moment in our country's history," he said. "I remain in control of myself, confident in what I think."

Michael Jordan got married over the weekend in front of a few hundred of his family and closest friends.

The Charlotte Bobcats owner exchanged vows with 35-year-old former model Yvette Prieto on Saturday in Palm Beach, Fla., Jordan's manager Estee Portnoy told The Associated Press Sunday

The wedding took place at the Episcopal Church of Bethesda-by-the-Sea with nearly 300 guests in attendance, including Tiger Woods, Patrick Ewing, Spike Lee and Ahmad Rashad.

The ceremony was followed by a reception at the Bear's Club in Jupiter, Fla., a luxurious private golf club designed by Jack Nicklaus. Jordan, 50, owns a home near the course.

There were fireworks at night as part of the celebration.

In lieu of wedding gifts, donations were made to the James R. Jordan Foundation. The wedding flowers were donated to the Jupiter Medical Center.

The six-time NBA champion and Prieto met five years ago and were engaged last December.

Prieto wore a French silk voile corseted sheer sheath gown by J'Aton Couture, in an ecru palette with accents of flesh tones, with handmade silk lace created especially for her, and enhanced with Swarovski crystals. The gown featured French seamed crinoline borders, which cascaded into a dramatic cathedral train finished in the lace, with accents of a peacock-feathered design.

The couple and their guests were entertained by DJ MC Lyte, singers K'Jon, Robin Thicke and Grammy-Award winner Usher and The Source, an 18-piece band.

Everyone enjoyed an all-white, seven-layer white rum wedding cake that was covered in white fondant and sugar crystals, and adorned with crystal brooches and the couples' monogram on the top layer.

Guests sat at tables that were a continuous candle-lit landscape with a myriad of crystal candelabras and mercury glass vessels, each filled with one variety of white flower, including roses, peonies and tulips, and one accent of purple.

Obama to honor firefighters killed in Texas blast

By Tim Gaynor

WACO, Texas (Reuters) - President Barack Obama will assume a familiar role consoling family and friends of disaster victims on Thursday when he speaks at a Texas memorial for firefighters killed in a massive explosion at a fertilizer plant.

Just a week after he traveled to Boston following the Marathon bombing that killed three people, he will speak at a memorial on the campus of Baylor University in Waco to honor the 11 first responders who died in the blast.

Organizers expect thousands of first responders to attend the service at a college basketball arena that seats more than 10,000 people. A procession of firefighters and some 300 fire trucks from across the country will be held before the service.

The April 17 explosion at the West Fertilizer Co plant obliterated a residential section of the small Czech-American town of West, Texas, 20 miles from Waco. It killed 14 people and injured some 200.

The town of 2,700 people had 33 volunteer fireman. Five died when they responded to a fire alarm, and the plant exploded 20 minutes later. Four paramedics from nearby towns who were also firefighters, and were attending a class in West on the night of the disaster, rushed to the scene and were killed.

The other two casualties among first responders were an off-duty Dallas fireman who lived in West and a local welder who went to the plant to help.

The explosion, which had the force of a small earthquake, left a huge crater in the ground at the plant.

Investigators have not determined the cause of the blast, although they suspect an industrial accident stemming from fertilizer stored on the premises.

In addition to Obama, speakers will include Texas Governor Rick Perry and Baylor University President Kenneth Starr, best known for his investigation of the sex scandal involving then President Bill Clinton and White House intern Monica Lewinsky during the 1990s.

The explosion occurred two days before the 20th anniversary of a huge fire that destroyed the compound of the Branch Davidian religious sect near Waco, ending a standoff with federal agents. The sect's leader, David Koresh, and dozens of his followers were killed and the government was accused of heavy-handed action in the tragedy.

Investigators of the fertilizer plant blast have not ruled out arson, but have said there is no indication of foul play.

Toll in Bangladesh building collapse climbs to 290

SAVAR, Bangladesh (AP) ? Crews bored deeper Friday into the wreckage of a garment-factory building that collapsed two days earlier, hoping for miracle rescues that would prevent the death toll from rising much higher, as angry relatives of the missing clashed with police.

Some of those trapped under fallen concrete in the Rana Plaza building were still alive, rescue workers said, but they were so badly hurt and weakened that they will need to be extricated within a few hours if they are to survive.

Brig. Gen. Mohammed Siddiqul Alam Shikder, who is overseeing rescue operations, said the death toll at the Rana Plaza building had reached 290, and that 2,200 people have been rescued. The garment manufacturers' group said the factories in the building employed 3,122 workers, but it was not clear how many were inside it when it collapsed Wednesday.

Hundreds of rescuers, some crawling through the maze of rubble, spent a third day working amid the cries of the trapped and the wails of workers' relatives gathered outside the building, which housed numerous garment factories and a handful of other companies.

Police cordoned off the building site, pushing back thousands of bystanders and relatives, after rescue workers said the crowds were hampering their work.

Clashes erupted between relatives of those still trapped and police officers, who used batons to disperse the mobs. Police said 50 people were injured in the clashes.

"We want to go inside the building and find our people now. They will die if we don't find them soon," said Shahinur Rahman, whose mother is missing.

An army rescue worker, Maj. Abdul Latis, said he found one survivor still trapped under concrete slabs, surrounded by several bodies. At another place in the building, four survivors were found pinned under the debris, a fire official said.

The rescue workers said they were proceeding very cautiously inside the crumbling building, using their hands, hammers and shovels, to avoid more injuries to trapped survivors and avoid further collapses.

Police say cracks in the building had led them to order an evacuation of the building the day before it fell, but the factories ignored the order.

A military official, Maj. Gen. Chowdhury Hasan Suhrawardy, told reporters that search and rescue operations would continue until at least Saturday.

"We know a human being can survive for up to 72 hours in this situation. So our efforts will continue non-stop," he said.

Some people have been pulled out of the wreckage alive, though severely weakened, more than a day after the collapse.

Forty people had been trapped on the fourth floor of the building until rescuers reached them Thursday evening. Twelve were soon freed, and crews worked to get the others out safely, said Brig. Gen. Mohammed Siddiqul Alam Shikder, who is overseeing rescue operations. Crowds at the scene burst into applause as survivors were brought out.

The odor of decaying bodies at the site of the collapse, in the Dhaka suburb of Savar, is a constant reminder that many garment workers were not so lucky.

Thousands of workers from the hundreds of garment factories across the Savar industrial zone and other nearby industrial areas have taken to the streets to protest the collapse and poor safety standards.

Local news reports said protesters had smashed dozens of vehicles at one strike Friday. Most of the other protests were largely peaceful.

The disaster is the worst ever for Bangladesh's booming and powerful garment industry, surpassing a fire five months ago that killed 112 people and brought widespread pledges to improve the country's worker-safety standards.

Instead, very little has changed in Bangladesh, where wages, among the lowest in the world, have made it a magnet for numerous global brands.

96% War Witch

All Critics (46) | Top Critics (16) | Fresh (44) | Rotten (2)

Canadian writer-director Kim Nguyen spent nearly a decade researching this docudrama about child soldiers in Africa, and the film feels as authoritative as a first-hand account.

A haunting take on unspeakably grim subject matter, shot on location in the Democratic Republic of Congo.

A powerful and upsetting portrait of a young girl compelled into unimaginably horrific circumstances.

Nguyen, astonishingly, manages to wring something vaguely like a happy ending from this tragic story.

War Witch is most effective not when we are looking in on Komona but when we are inside her head.

The powerful things we expect from "War Witch" are as advertised, but what we don't expect is even better.

You're likely to ponder its images, its insights into a very foreign (for most of us) location and the tragic situation of Komona (and others like her) for a long time to come.

Is it accurate depiction of Africa's child soldiers? I don't know, thank God. But it feels authentic to its very core, and that makes it as hard to forget as it is to ignore.

Brutal without turning exploitative, the result is harrowing and heartbreaking.

Nguyen creates a mesmerizing tone through his camerawork, editing, sound and the infusion of African folk imagery and ritual, but it's Mwanza's performance as Komona that makes "War Witch" feel so miraculous.

Nguyen reportedly worked on "War Witch" for a decade, and it shows in both the immediacy and authenticity of his tale, and the meticulous craft with which it's told.

Made with extremely clear-eyed restraint from harangues, sentiment, message-mongering, or anything else that would cheapen its central character's suffering and fight.

War Witch features a standout performance by Rachel Mwanza, but the supernatural visions don't really suit the film's tone and mood.

Nguyen's compassion and commitment to the issue is admirable, and at its best, War Witch is devastating.

War Witch is remarkable for the fact that it never strays into sentimentality or sensationalism.

...a love story between youngsters who are forced to become adults all too early in their lives.

This is a straight ahead essay on warfare at its worst and the survival of the human spirit at its best.

An astonishing drama set in Africa that vividly depicts the courage and resiliency of a 12-year-old girl whose spiritual gifts enable her to survive.

It is astonishing that film that contains such violence can have such a serene tone. The source of the serenity is the measured, calm narration by Komona (voice of Diane Umawahoro) that is the telling of her story to her unborn child

An exquisitely made film in direct contrast to the ugliness of its subject matter

The portrait of a girl who retains her dignity and strength, her faith in the future, in the face of unimaginable horrors. It's inspirational in a very real way.

Hope Against Hope

Anti-gun activists hold up signs against guns and the NRA while in McPherson Square in Washington April 25, 2013. Anti-gun activists gather in McPherson Square in Washington D.C. on April 25, 2013

In its heyday, Occupy D.C. spread like kudzu over most of McPherson Square, conveniently located right between the White House and K Street. The encampment was razed 14 months ago; the only evidence that dozens of humans used to sleep, book-share, and ?mic check? there is the sad, randomly patchy state of the grass.

On Thursday, the grass was trampled one more time, for a cause. Occupy the NRA was starting its marquee media event in the park. The collective handed out new Shepard Fairey-designed posters, which featured an ironic NRA logo of a bird with a target on its chest and a slogan slightly less catchy than HOPE:

AMERICA, the Land Where God Saves & Satan Invests in Assault Weapons and High Capacity Magazines

A crowd of 60 or so activists gathered in front of a stage, flanked by novelty-sized checks that thanked lobbying groups ?for shooting down common-sense gun laws.? Two dozen reporters flitted around, making the most of a rally that had been scheduled to happen nine days earlier, before the Boston Marathon bombing Occupied the news cycle. It was up to ?activist and teacher? Justin Wedes to explain the connection between the movement, the march, and the restless anger over gun control?s April defeat.

?I?m not speaking for Occupy Wall Street,? he said. ?Nobody speaks for Occupy Wall Street. I?m a teacher, and a concerned citizen. I?m seeing the violence happening across this country. I?m seeing young kids die. I?m seeing mothers crying. It?s unacceptable, and to Occupy Wall Street, and to every Occupier, it should be unacceptable because these deaths are profitable. It?s profitable to the groups whose names you see on these checks here.? So he?d join their march, walked as close as possible to the lobbyists? offices, and shamed those names. ?I consider this a form of economic vigilante justice,? he said.

The recent gun control debate, which lasted roughly from the week of the Newtown shooting to last week, saw an oddly controlled spasm of political activism. The Obama administration and pro-gun bill Democrats basically got to pick their advocates?victims? families, Gabrielle Giffords, Michael Bloomberg, Michael Bloomberg?s bottomless checking account. The angry people let into the Senate gallery last week were siblings and mothers of shooting spree victims, not Occupiers. These were the people Joe Biden met with, just today, not far from the Occupy gathering.

But that didn?t work. The next gun control campaign is more anarchic. Democrats pulled their Senate reform package because doing so meant?theoretically!?tweaking it and winning a vote later in the year. But they haven?t updated their applause lines. Democrats still describe ?background checks,? however constructed, as something supported by ?90 percent of Americans.? That?s after the White House?s pollster Joel Benenson told them that the support was soft, and told them why. ?The American people already think that these gun safety proposals are in place,? said Joe Biden last month. After the other pollsters moved on, Princeton Survey Research made the calls and found support for any kind of gun bill slipping to a 49-45 yes-no margin.

Any gun control advocate who was honest with himself had to expect that. The Newtown shooting was in December; people have short memories, even for most sorts of national traumas. Some Democrats whisper that another shooting, another media frenzy, could restart the clock. In the meantime, they?re aimless. On Wednesday, Bloomberg?s Mayors Against Illegal Guns belatedly released a report fretting about the ?terror gap,? the fact that people on terror watchlists can buy guns. But there?s no evidence that the Tsarnaev brothers were on such a list. In 2007, Wayne LaPierre smacked down one legislative version of a fix by warning that it would bestow upon ?a future attorney general of the United States?think, a Hillary Clinton administration?power to declare anyone to be a ?prohibited person? on a par with a convicted felon or fugitive from justice, all done in total secrecy.?

The goal of the December-through-April gun fight was simply to win, on anything. ?There?s a cultural problem you need to deal with first,? said one of the Thursday organizers, Steve Clermont, as leaders told the marchers with the novelty checks to head to the front. ?Once you pass a bill, then people who are up for re-election in 2014 win anyway, the attitude changes.?

The grassroots and the White House agree on that, completely. The entire Thursday march was structured to accuse lobbyists of literally profiting from murder?no other motivation was possible. But where?s the proof that a top-down strategy, a Senate win on something called ?the gun control compromise,? would change this? The month of Obama-Biden gun control speeches during the pre-Manchin-Toomey lull got incredibly specific about the NRA, with the president mocking anyone who would worry about losing an A-plus rating from the group.

Shaming rural state politicians who crib NRA rhetoric doesn?t move them. It freezes them in place. ?I'm so frustrated by the tenor of this discussion that this will solve a problem that it won't solve,? North Dakota Sen. Heidi Heitkamp told the Williston (N.D.) Herald this month, before voting against the Toomey-Manchin gun compromise. ?People who have always been opposed to guns are making this about guns, when we should be making it about mental health.?

I walked in the mix with the Occupy NRA crowd as they crowded the first of the targeted lobby shops. They didn?t get close; police, who?d kindly let the marchers walk freely on D.C.?s main streets, formed a line in front of the building, several floors below the target?s office. (Also, no one leading the march remembered who the target was?Crossroads Strategies, maybe.)

?We need to get clever, like the NRA,? said Leah Gunn Barnett. She was the executive director of New Yorkers Against Gun Violence, one of the speakers at the rally, right after a mother whose daughter had been shot in D.C. ?They?ve been working away at passing concealed carry laws in the states for years. That?s how you win, not with something at the federal level. We have to change norms, and that starts at the local level.?

Just then the protest actually got underway, and drowned out our conversation.

Down with lobbyists! Down with the NRA!

Ice tubes in polar seas -- 'brinicles' or 'sea stalactites' -- provide clues to origin of life

Apr. 24, 2013 ? Life on Earth may have originated not in warm tropical seas, but with weird tubes of ice -- sometimes called "sea stalactites" -- that grow downward into cold seawater near Earth's poles, scientists are reporting.

Their article on these "brinicles" appears in ACS' journal Langmuir.

Bruno Escribano and colleagues explain that scientists know surprisingly little about brinicles, which are hollow tubes of ice that can grow to several yards in length around streamers of cold seawater under pack ice. That's because brinicles are difficult to study. The scientists set out to gather more information on the topic with an analysis of the growth process of brinicles.

They are shown to be analogous to a "chemical garden," a standby demonstration in chemistry classes and children's chemistry sets, in which tubes grow upward from metal salts dropped into silicate solution. But brinicles grow downward from the bottom of the ice pack.

The analysis concluded that brinicles provide an environment that could well have fostered the emergence of life on Earth billions of years ago, and could have done so on other planets. "Beyond Earth, the brinicle formation mechanism may be important in the context of planets and moons with ice-covered oceans," the report states, citing in particular two moons of Jupiter named Ganymede and Callisto.

Reese Witherspoon's Mug Shot Pose Explained

There's something strange about Reese Witherspoon's mug shot -- besides the fact that it exists in the first place. After being arrested for disorderly conduct in Atlanta, the actress, who has admitted to having "one drink too many," posed for the obligatory photo. Her husband Jim Toth, who was arrested for DUI, stares straight ahead in his photo. But Reese isn't even looking at the camera. Isn't that a little odd?

Bethenny Frankel Custody Battle Gets Sadder

This is starting to work its way into an all time low. Bethenny Frankel and Jason Hoppy are really throwing below the belt punches in the battle to get full custody of their kid. The most recent news is that Bethenny will have to undergo a “parenting evaluation” as part of the proceedings. The court has apparently ordered the evaluation, which will include a caseworker of some sort going into her home to examine how she parents and provides for Bryn. No parent would be comfortable with such a situation, it is really on the list of worst nightmare scenarios to have someone place judgement on your ability to parent. This is different than a friend of family member giving advice. In this case, it will end up being reported back to the court. How sad. Anyway, that is exactly the scenario Bethenny is facing. Here is how a source described her feelings on the subject: “Bethenny is furious that her parenting style and methods are going to be questioned. Bryn is her whole life, and she doesn?t want anyone to assess her mothering skills.? “She does not want a complete stranger to come into her home and pass judgment [...]

Repairing articular cartilage defects with an injectable gel engineered with gene modified BMSCs

Apr. 23, 2013 ? Researchers at Micro Orthopaedics, Zhongnan Hospital of Wuhan University, led by Dr. Ai-xi Yu, have suggested that articular cartilage defects can be repaired by a novel thermo-sensitive injectable hydrogel engineered with gene modified bone marrow mesenchymal stromal cells (BMSCs). The chitosan and polyvinyl alcohol composite hydrogel containing hTGF?-1 gene modified BMSCs was injected into rabbits with defective articular cartilage. Sixteen weeks later the defected cartilage regenerated and was proven to be hyaline cartilage.

This work can be found in the January 2013 issue of Experimental Biology and Medicine.

"No reliable approach is currently available for complete restoration of damaged articular cartilage," said Dr. Bai-wen Qi, "in this study, CS/PVA gel was combined with rabbit bone marrow stromal cells (BMSCs) transfected with hTGF?-1 and used to repair rabbit articular cartilage defects and the repair effect was evaluated."

Tissue engineering combined with gene therapy technology has the potential to manage the repair of defective articular cartilage. In this study, through minimally invasive injection methods the authors were able to repair rabbit articular cartilage defects with CS/PVA gel and gene modified BMSCs. Dr. Qi said "CS/PVA gel can be applied to the repair of articular cartilage defects as an injectable material in tissue engineering, and the regenerated cartilage can secrete cartilage matrix and perform the functions of hyaline cartilage. Use of this gel for cartilage repair has advantages such as the minor surgical procedure required, tight bonding with the damaged tissue and lack of rejection."

Dr. Steven R. Goodman, Editor-in-Chief of Experimental Biology and Medicine said "The study by Qi and colleagues is very exciting as it combines tissue engineering and gene therapy approaches to successfully repair defective articular cartilage. The approach should be adaptable in the future to human tissue repair."

NASCAR penalizes Kenseth after engine fails

CHARLOTTE, N.C. (AP) ? NASCAR has a zero tolerance policy when it comes to engines, tires and fuel on a race car. Anything even slightly improper is dealt with swiftly and severely. NASCAR always throws the book at offenders.

Matt Kenseth and Joe Gibbs Racing were no exception, getting hit with one of the largest penalties in NASCAR history Wednesday after the engine from Kenseth's race-winning car at Kansas failed a post-race inspection. The team had nothing to do with the error, and manufacturer Toyota immediately accepted responsibility for one of eight connecting rods failing to meet the minimum weight requirement by 3 grams ? less than an empty envelope.

"We take full responsibility for this issue with the engine. JGR is not involved in the process of selecting parts or assembling the Cup Series engines," Toyota Racing Development President Lee White said.

It's been a busy season for NASCAR discipline. In February, Nationwide Series driver Jeremy Clements was suspended after an apparently insensitive remark to an MTV blogger and Denny Hamlin was fined $25,000 for criticizing the new Gen-6 race car.

But in the past week, NASCAR has levied more than $450,000 in fines, suspended nearly a dozen crew members for upcoming points races, and knocked some of the top drivers in its series out of the top five as it punishes teams for rules violations involving the cars themselves.

Kenseth was stripped of everything but the trophy from Sunday's win at Kansas.

He was docked 50 driver points in the standings ? he earned only 48 points for the victory ? and NASCAR also erased the three bonus points he earned for the win that would have been applied in seeding for the Chase for the Sprint Cup championship. In addition, the victory will not be credited toward his eligibility for a wild card berth in the Chase.

So, although Kenseth has two wins on the year, the Kansas win does not count in any form toward Chase eligibility. He lost his pole award, too, which could hurt eligibility for next year's Sprint Unlimited exhibition race.

The penalty to Kenseth, who held off Kasey Kahne of Hendrick Motorsports to earn his second win of the season, dropped him from eighth to 14th in the standings.

NASCAR also suspended crew chief Jason Ratcliff for six races and fined him $200,000. And in a rare move, car owner Joe Gibbs had his owner's license suspended for the next six races and he won't earn car owner points during that time. He also was docked 50 car owner points while Toyota, which supplies the JGR engines through Costa Mesa, Calif.-based TRD, lost five points in the manufacturer standings.

JGR said it would appeal.

"It is our understanding that one of the eight connecting rods on the engine was ruled too light," the statement said. "We are working with our partners at TRD on this issue."

White said Kenseth gained no advantage from the light rod.

"It was a simple oversight on TRD's part and there was no intent to deceive, or to gain any type of competitive advantage," White said. "Toyota is a company that was built on integrity, and that remains one of the guiding principles of the company. The goal of TRD has always been ? and will continue to be ? to build high-performance engines that are reliable, durable and powerful, and within the guidelines established by NASCAR."

It's the second severe penalty against a Sprint Cup team levied by NASCAR in as many weeks.

It was Penske Racing and defending Sprint Cup champion Brad Keselowski who were punished last week after NASCAR said it found unapproved parts in the rear suspension of Keselowski and Joey Logano's cars at Texas. NASCAR docked 25 points each the drivers, fined the crew chiefs $100,000 each and suspended seven Penske employees for six races. Penske Racing's appeal is scheduled for May 1.

Those penalties were for alterations to the body of the car, particularly in an area NASCAR has been working the last year to police after teams found a way to manipulate the skew of the cars last season. Team owner Roger Penske has maintained the team was not cheating, but "working in a gray area" of the rule book.

It's not clear if that argument will fly before the three-member appeal board, and the 2013 rule book was specifically tightened this season to add language specific to the rear suspension systems.

In the case of JGR and the engine, illegal is illegal and there is no gray area.

NASCAR has proven that through penalties before. The last violator, Carl Long, was severely punished when he was found to have an illegal engine at the 2009 All-Star Race. Long was docked 200 points ? which would be about 50 points under the current points system ? fined $200,000 and suspended for 12 races.

His suspension was reduced to eight races on appeal, but Long has said he is unable to pay the fine and can't work in Sprint Cup until he settles the debt.

"We've always known the engine and tires are sacred ground. You don't mess with the engine or the tires," said former crew chief and current Fox analyst Larry McReynolds, who added that all eight connecting rods would have been light if TRD was trying to cheat.

"This was pure human error," McReynolds said. "But in NASCAR's defense, they can't completely determine intent or non-intent. They absolutely should appeal. I'd primarily appeal Ratcliff's suspension. He was an innocent bystander in this. The engine is a different deal than the rest of the car. If I was Joe Gibbs, I'd be pretty ticked off about losing my crew chief under these circumstances. This was an error but an enormously costly one."

JGR has the means to pay the fine and the personnel to recover from this setback. The appeal would likely be to reduce the penalties on the argument it was TRD that erred and the team had no control or access to assembly of the engine.

Kenseth is unlikely to get back his bonus points. NASCAR stripped Carl Edwards of his 10 bonus points under an older scoring system for not having a cover on his oil tank after a 2008 win at Las Vegas. The victory stood, but Edwards was not able to carry the 10 bonus points into the Chase. His crew chief was also suspended six races.

Warm weather helps drive surge in motorcycle deaths

Alan Spearman / The Commercial Appeal file

Driver Jimmy Vinson waits for the scene of a motorcycle accident to be cleared on March 26, 2012, in Memphis, Tenn. No one died in this crash, but more than 5,000 riders were killed nationwide last year, according to preliminary accident data.

By Mark Schone, NBC News

U.S. motorcyclist deaths surged 9 percent last year to more than 5,000 -- near a record high -- in part because warm weather lured more riders out on the road last spring, but also because of a long-term decline in helmet laws, according to a report issued Wednesday by the Governors Highway Safety Association.

"All of the trends with motorcycle deaths are really going in the wrong direction," said GHSA Chairman Kendell Poole, highway safety director for the state of Tennessee. "We are talking about 5,000 tragedies a year with no sign of progress."

The projected rise, based on preliminary accident data, outpaced the national increase in overall traffic fatalities, which rose from 5 percent to 7 percent in 2012, and marked the 14th time in the past 15 years that motorcycle deaths have increased. Over the same period, traffic deaths involving all varieties of vehicles have fallen by 23 percent, according to the GHSA.

"The most notable thing was the warm weather," said Dr. James Hedlund, the author of the report and a former official with the National Highway Traffic Safety Administration. "Motorcyclists in a number of Northern states were out on the road a lot earlier." Thirty-four states east of the Rocky Mountains notched record average temperatures from March to May 2012.

Read the GHSA report: Motorcyclist Traffic?Fatalities by State

The report also cited two economic factors that may have contributed to an increase in the number of miles traveled via motorcycle in 2012 and a higher probability of accidents: a better economy and high gas prices.

"An improving economy and produces more discretionary income with which to buy and ride motorcycles," said the study. Several states reported an increase in the number of registrations in 2012, likely because of improved economic conditions. Hedlund has found that over the past three decades, the number of registrations tracks closely with the number of deaths.

The improving economy may also have contributed to the increase in overall motorist fatalities in 2012, since more disposable income means more miles driven in all types of vehicles. With gas prices still high, however, the report suggested that motorcycle riders may have decided "to use their fuel-efficient motorcycles rather than automobiles for commuting and other everday travel," thus increasing rider deaths.

The report recommended that states address a number of issues in order to reduce motorcycle deaths, especially encouraging an increase in helmet use. "The most effective strategy by far," asserted the report, "is to enact a universal helmet law in the [states] that lack them." Only 19 states now require riders to wear helmets, down from 26 in 1997.

The last state to enact a helmet requirement was Louisiana in 2004. In 2012, Michigan dropped its requirement and made helmets voluntary.

Michigan's new law went into effect last April. Preliminary totals from the Michigan Office of Highway Safety Planning projected 129 motorcyclist deaths in the state for 2012, an 18 percent increase over 2011.

The Michigan chapter of ABATE, a motorcyclist group opposed to mandatory helmet laws, said in a statement to NBC News that the fatalities "fall within the normal range of variation" and can't be attributed to the relaxed law. ABATE also referenced the warm weather and an increase in registration as possible factors. "Our primary concern about the accuracy of the data from (the state Office of Highway Safety Planning) is that two single points of data are being compared, when a multiyear comparison will give the clearest and most accurate depiction," said Vince Piacenti, statistician for ABATE Michigan.

Hedlund said that he had not analyzed the Michigan data, but said the variation was not small. "Numbers can vary, particularly in fairly small states," he said, "but Michigan's numbers went up substantially."

ABATE also noted that more than half of Michigan bikers who died in 2012 were "not endorsed to operate a motorcycle." GHSA's recommenddations for cutting motorcyclist deaths include reducing alcohol impairment, reducing speeding and ensuring that motorcyclists are licensed. According to GHSA, NHTSA data shows that in 2010, nearly a quarter of riders involved in fatal accidents did not have valid licenses.

'Dancing' dud Andy Dick struggles again

Craig Sjodin / Craig Sjodin / ABC

By Ree Hines, TODAY contributor

The ballroom battle continued to heat up on "Dancing With the Stars" Monday night, but there was more than one battle going on in the competition.

At the top of the leaderboard, the fight was for first-place bragging rights -- ?and that continued to be a neck-and-neck battle between "Dancing" queens Zendaya and Kellie Pickler (more on that later). But from the back of the pack, Andy Dick was fighting too -- fighting to stay in the competition.

Andy is far from the best dancer, but what the actor-comedian lacks in technique, he more than makes up for with sincerity and fun.

For his latest routine, he attempted a sexy samba with partner Sharna Burgess. What he delivered didn't exactly look like a samba, and it certainly wasn't sexy. But it was big on personality, and there wasn't anything halfhearted about it.

"Andy, if the others have climbed hills, you have climbed mountains," head judge Len Goodman said of his efforts.

But moving mountains doesn't show up on the scoreboard. Len and his fellow panelists gave Andy 6s all around.

Fair enough -- or at least it would have been, had the judges not given former "Bachelor" Sean Lowe three more points than that for his own seriously flawed samba.

Len told Sean he needed to set his sights higher than just beating Andy -- a low blow that earned boos from Andy's fans

"Is that the best you can do with the booing?!" Len asked, egging on the crowd.

If that slight made Andy's supporters unhappy, their moods didn't improve after Victor Ortiz took the floor. The boxer looked lost throughout his rumba routine and obviously missed a few steps along the way. Heck, he knew it was bad -- he was shaking his head when it was all over. Still, what turned out to be the worst dance of the night earned him the exact same score as Andy.

The other stars had a far better night. Actor Ingo Rademacher put on his best dance yet with a 24-point tango, and Aly Raisman beat him with her flowing 27-point foxtrot.

And as for the aforementioned "Dancing" queens, they both proved worthy of heir matching scores of 29 points. Zendaya's near-perfect cha-cha wowed the crowd, and Kellie's quickstep wowed Len (who handed out his first 10 of the season for it).

But everyone had one more chance to add to their scores before the night was over. In honor of the show's theme for the evening -- Stevie Wonder night -- the celebs split into teams for group routines.

Team Paso, made up of Zendaya, Ingo, Jacoby and Victor, moved to "Higher Ground," while Team Samba (Kellie, Sean, Aly and Andy) grooved to "Supersition." The judges favored the latter act, giving the samba set a score of 25 points versus 23 for the other team. And that made all the difference when it came to the various ballroom battles.

Suddenly the "Dancing" queens weren't neck-and-neck, as Kellie nabbed the lead for the night.

And Andy? He just barely climbed out of last place thanks to those extra points. Of course, only time will tell if he has enough support from fans to stick around on beyond Tuesday night.

Do you think Andy Dick should survive another week in the ballroom bash? Share your thoughts on our Facebook page.

PSA Twitter is down for some, as is iCloud and the iTunes Store

Nope, it's not your picture of "the best duck confit I've ever had" that's causing that Twitter post to error out -- the service is down for "some users," according to a Twitter status page update. It's unknown what's causing the issue (again, probably not your photweet), but we're assured "engineers are currently working on this issue." We're experiencing some snags ourselves, usually resulting in tweets timing out before publishing. Hang tight!

But maybe don't try to while away your time on the iTunes Store or by backing up your phone to iCloud, as those services are also experiencing some downtime issues this morning. An Apple support page lists both as seeing "some users affected;" we'll just have to assume engineers are also hard at work on fixing that. As always, we'll let you know when things get better.

Update: Looks like Twitter is all back to normal, and the company says, "this issue has been resolved." Apple, on the other hand, is still having issues with Apple ID and Game Center login.

Update 2: Apple is now all back to normal as well, according to the company's support page. But do let us know if you're experiencing any issues!
